Cautionary Tales from the Courthouse: Real Cases and Real Lessons to Reduce Risk
Summary
This 60-minute presentation will review several recent appellate court opinions from across the country that illustrate current judicial attitudes toward healthcare professional liability or healthcare regulation litigation.
Objectives
- Examine the framework for healthcare professional liability negligence litigation to limit liability.
- Review the framework for EMTALA litigation, including recent rulings.
- Describe risk management lessons from recent litigated cases.
Speakers
Maggie L. Neustadt, JD CPHRM DFASHRM, Vice President of Risk Management for BJC Health System
Maggie manages the professional and general liability claims and advises the health system on clinical risk identification, reduction, and mitigation strategies. She is a driver of patient safety initiatives and acts as a patient safety liaison facilitating disclosure conversations with patients and families following significant unexpected events.
Maggie is a frequent presenter on ethical and legal issues to healthcare professionals and associations spanning the continuum of healthcare delivery. She is a member of the Kansas Bar Association, Missouri Bar Association, and American Society of Healthcare Risk Managers and was awarded certification as a Professional Healthcare Risk Manager from the American Hospital Association and was awarded Fellow designation in 2020. Maggie started her career in law with Husch Blackwell in KCMO in 2001.

Nurses

Loss Prevention Annual Policy Credit
Individual Providers
By participating in the 2026 Loss Prevention program, eligible insureds receive a 5% loss prevention credit on their 2027 policy premium. This applies to individually insured members.
Facilities
A facility’s administrator or risk manager must participate in the Loss Prevention program in order for the facility to receive the 5% loss prevention credit.
Uninsured Providers
Individuals who participate in this program and are not currently insured by KAMMCO may be eligible for a policy premium credit if they become insured by KAMMCO within one year of participation.
